Meghan Markle makes legal bid to stop Harry being quizzed under oath in defamation case

Meghan Markle has made a legal bid to stop her half-sister’s demands that Prince Harry should be quizzed under oath in a United States defamation case.

The 57-year-old alleges that the former Suits actress defamed her with claims that she was raised as an “only child”.

Samantha claims she suffered humiliation and distress as a result of her younger sibling’s statement.

She also accused Meghan of peddling a "rags to riches" story.

Lawyers confirmed they wanted to depose Thomas Markle and Oprah Winfrey alongside Prince Harry as witnesses during their testimony.

But Meghan has hit back with her legal team telling a judge to stop collecting and releasing evidence until a ruling is made over whether the lawsuit should be thrown out.

Her team claimed her statements on Samantha were "non-actionable opinion” and also “substantially true".

They say the "only child" comment was a "subjective feeling" and "obviously not meant to be a statement of objective fact".

Representatives also argued Meghan couldn't be held liable for comments in book Finding Freedom as she is not the author or publisher, with Omid Scobie - who penned the book - also dismissing the claims.

A legal filing on behalf of Meghan also claimed a deposition of Thomas Markle at this time would be “an unnecessary spectacle” and waste of the parties' time, money, and resources”.

It continued: “Samantha Markle should not be permitted to force Meghan and, potentially, numerous non parties to devote substantial resources to extraneous discovery while a meritorious motion that could dispose of the entire case is pending…

“In addition to the parties, Samantha identified a whopping 19 non-party witnesses, including Prince Harry, Meghan's mother, Oprah Winfrey, and several journalists/media personalities who reside in the United Kingdom, including Scobie and Durand, the authors of Finding Freedom.”
